Abstract

U ovom diplomskom radu istražuju se metode i prava zaštite potrošača kod ugovora o financijskom leasingu. Polazište je definiranje posla leasinga, vrsta leasinga te osnovnih značajki financijskog leasinga. U kontekstu financijskog leasinga daje se dublji uvid u stavke ugovora o financijskom leasingu. Također, dodatan naglasak stavlja se na potencijalne rizike pri ugovaranju financijskog leasinga na koje bi potrošači trebali obratiti pozornost. Definiranjem prava potrošača u domaćoj i europskoj regulatornoj sferi, dobivena su osnovna saznanja o pravima potrošača pri ugovaranju financijskog leasinga. Analizom primjera iz prakse, daje se dublji uvid u metode zaštite potrošača te se navode prepreke s kojima su potrošači suočeni. Neinformiranost potrošača predstavlja najviše izraženu prepreku koja uz prihvaćanje općih uvjeta poslovanja pri ugovaranju financijskog leasinga, stavlja potrošača u slabiji položaj u odnosu na davatelja leasinga. U radu se također iz prikazanih odluka HANFE, jasno prezentira visoka razina zaštite koje pružaju službene institucije. Nastavno, prikazanom suradnjom službenih institucija i udruga za zaštitu potrošača, potrošačima se osigurava sveobuhvatna zaštita. Na temelju provedenog istraživanja postojećih ugovora o financijskom leasingu iz poslovne prakse i njihovih utjecaja na potrošače, izveden je zaključak. Prilikom pisanja rada primijenjena je metoda logičkog zaključivanja, deskriptivna metoda, povijesna metoda te metoda analize, sinteze i klasifikacije. Očekivani doprinos rada je potencijalnim potrošačima ponuditi različite smjernice te dostupna rješenja kako navigirati poslovima financijskog leasinga u slučaju potencijalnih izmjena. Stručni doprinos autora ogleda se u primjerima koji će pratiti teorijski dio rada te koji objedinjavaju važne informacije za zaštitu potrošača kod ugovora o financijskom leasingu.

Abstract (english)

In this master thesis, the methods and rights of consumer protection in finance lease agreements are being researched. The starting point for the development of thesis is the definition of lease agreement, types of lease agreements and main characteristics of such agreements. In the aspect of finance lease agreement, author provides extensive insight into finance lease agreement focal points. Furthermore, emphasis is also placed on potential risks on which should consumers place their undivided attention. By defining rights of consumers both in Croatia and EU countries, basic clauses of consumer rights when entering the finance lease agreement contracts are being identified. When analyzing the real life cases of conducting the finance lease agreements, a profound insight into methods of consumer protection is given and main obstacles with which are consumers being faced, are pointed out. Lack of information from consumer standpoint presents an obstacle, which in conjunction with accepting general terms and conditions, can place the consumer into inferior position compared to the lessor. In this research master thesis, from the formal decision of Croatian agency for supervision of financial services, one can conclude that the high standard of protection is being given by the formal financial institutions. Moreover, with shown coordination between formal and informal institutions such as consumer protection organizations, consumers are faced with comprehensive protection. Based on the conduction of research of present financial lease agreements in practice and their effect on consumers, a conclusion is deducted. When writing this thesis, the method of logical conclusion, descriptive method, historical method and method of analysis and qualification were being used. The expected outcome of the thesis is to offer different pointers and solutions to the potential consumers which will help them navigate through potential changes in the finance lease agreement regulation. Authors professional contribution is being acknowledged both in the theoretical part of the thesis and the focal points of consumer protection in finance lease agreements.
