Abstract

Korisnici bankarskih usluga postaju sve obrazovaniji i zahtjevniji, a od pojave interneta potrebne informacije postaju na dohvat ruke. Promijenjene preferencije korisnika dovele su do pojave novih kreditnih proizvoda, sudionika i načina pružanja bankarskih usluga. Postojeća Direktiva 2008/48/EZ Europskog parlamenta i Vijeća Europske unije iz 2008. godine, koja je obuhvaćala tadašnje ugovore o potrošačkim kreditima i sudionicima, postala je zastarjela te je zbog toga donesena odluka o reviziji navedene direktive. Cilj ovog rada je dati cjelovit prikaz potrošačkog kreditiranja u Republici Hrvatskoj, spoznati razlike koje je donijela revizija Direktive/2008/48/EZ te usporediti povoljnost pojedinih potrošačkih kredita. Revizijom Direktive/2008/48/EZ došlo je do isključenja pojedinih kreditnih proizvoda iz primjene Direktive zbog procjene da im okvir Direktive nije prilagođen, ili do djelomičnog izuzeća jer se smatra da predstavljaju manji rizik, kao i jasnijih pružanja informacija potrošačima, pojačane pravne sigurnosti i pojašnjenja procjene kreditne sposobnosti kako bi potrošači bili informiraniji i zaštićeniji prilikom donošenja odluka o uzimanju kredita. Na temelju istraživanja ponude potrošačkih kredita u Republici Hrvatskoj nije primijećeno odstupanje od odredaba nove Direktive Europskog parlamenta i Vijeća Europske unije o potrošačkim kreditima kao ni od Zakona o potrošačkom kreditiranju. Empirijski dio rada usmjeren je na uspoređivanje povoljnosti različitih oblika potrošačkih kredita iz aspekta dužnika: prekoračenje po tekućem računu, gotovinski kredit, revolving kredit te kupovina na rate. U danom scenariju gdje je osoba odlučila renovirati svoj stan, najpovoljnija opcija ispala je kupovina na rate zato što se na taj proizvod ne plaćaju kamate dok su najlošiji rezultati ostvareni kod prekoračenja po tekućem računu sa prosječnom efektivnom kamatnom stopom od 7,09%.

Abstract (english)

Since the advent of the Internet, the users of banking services are becoming more educated and demanding because the necessary information is at their fingertips. Changed user preferences have led to the emergence of new credit products, participants and means of providing services. The existing Directive 2008/48/EC of the European Parliament and the Council of the European Union from 2008, which lays down rules at EU level concerning consumer credit agreements, has become obsolete. Therefore, a decision was made to revise the aforementioned Directive. The aim of this paper is to provide a complete overview of consumer lending in the Republic of Croatia, to acknowledge differences brought with the revision of Directive/2008/48/EC, analyse the information for chosen consumer loans and compare their affordability for debtors. The revision of Directive/2008/48/EC has led to the exclusion of certain credit products from the application of the directive because the framework of the Directive is not adapted to them. Some of them are partially exempted because they are considered to be lower risk. The revision of Directive/2008/48/EC has also led to clearer provision of information to consumers, increased legal certainty and clarifications on assessment creditworthiness so that consumers are more informed and protected when making decisions about taking out a loan. Based on the research on the offer of consumer loans in the Republic of Croatia, no deviation from the provisions of the new Directive of the European Parliament and the Council of the European Union on consumer loans as well as from the Law on consumer lending was found. The following types of credit products were examined: overdraft, cash credit, revolving credit and purchase in instalments, and also compared in terms of their favorability for the debtor. In the given scenario where the person decides to renovate an apartment, the most favorable option turned out to be an installment purchase because no interest is paid on that product, while overdrafts were most expensive with an average effective interest rate of 7.09%.
